AdriaMart.rs — Standard Terms & Conditions of Sale
1. General
Welcome to AdriaMart.rs (hereinafter referred to as “the Website”).
By accessing, registering, placing orders, or using any of the services provided by the Website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions of Sale (hereinafter referred to as “the Terms”).
If you do not agree with any part of these Terms, please stop using the Website immediately.
2. Definitions

User: Any individual or entity who registers, browses, places an order, or uses services on the Website.
Seller: A merchant who sells goods through the Website (if applicable).
Buyer: A User who purchases goods through the Website.
Products: Items displayed and available for purchase on the Website.

4. Orders and Contract Formation
An order placed and successfully paid by the User constitutes a legally binding sales contract.
The Website will confirm the order and arrange shipment as soon as possible.
If an order cannot be fulfilled due to insufficient stock, incorrect pricing, or other reasons, the Website reserves the right to cancel the order, notify the User, and issue a refund.
5. Pricing and Payment
Product prices are based on the prices displayed on the Website at the time of order.
Whether taxes are included will be clearly indicated during checkout.
Accepted payment methods include (but are not limited to): bank cards, e-wallets, bank transfers, and cash on delivery (where applicable).
All online payments are processed through secure, PCI-DSS compliant payment gateways.
6. Delivery and Shipping
The Website will arrange shipment after confirming the order and payment.

Local Pickup Option:
(1) Buyers may select “Local Pickup” at checkout without any additional delivery fee.
(2) Once the order is confirmed, Buyers may collect their purchases at the designated pickup location (such as Belgrade Eurasia Market or Nis China Town) within the specified time window indicated in the confirmation email or message.
(3) Buyers must present their order number or proof of payment upon collection.
(4) If collection is to be made by an authorized representative, the Buyer must notify the Company in writing (via email or customer service) with the representative’s full name and contact details in advance.
(5) Orders not collected within the specified timeframe will be deemed unclaimed, and the Company reserves the right to cancel the order or return the products to stock.
(6) Upon collection, the Buyer shall be deemed to have inspected and accepted the goods, and the risk of loss and ownership shall immediately transfer to the Buyer.
Delivery times depend on logistics partners and the Buyer’s location.
The Company shall not be held liable for delays caused by force majeure, customs, or third-party logistics providers, but will assist Buyers in resolving such issues.
Deliveries are handled by authorized logistics partners such as Post Express, D Express, or other certified couriers.
7. Returns and Refunds
In accordance with Serbian and EU consumer protection laws, Buyers have the right to withdraw from the purchase within 14 days of receipt without providing any reason (“cooling-off period”).
Conditions for Returns:
The product must be intact, unused, undamaged, and returned with its original packaging, accessories, and invoice.
The following products are non-returnable:
Customized or made-to-order items;
Perishable goods or items with a short shelf life;
Hygiene, health, or media products once unsealed.
Defective or Incorrect Items:
Buyers may request a replacement or refund if the item is damaged, defective, or incorrect upon delivery.
Refund Process:
Refunds will be issued within 14 days after the Seller confirms receipt of the returned goods.
Buyers must contact Customer Service at support@adriamart.com before sending any item back.
8. User Obligations
Users must provide accurate and complete personal information, shipping address, and contact details.
Users are responsible for any losses resulting from inaccurate or incomplete information.
Users must not engage in fraudulent orders, abuse of return rights, or any illegal activity.
9. Platform Liability and Disclaimer
For goods supplied by third-party Sellers, the Website acts solely as an intermediary platform and is not directly responsible for product descriptions or quality.
The Website provides reasonable assistance to Buyers in disputes with third-party Sellers.
The Company reserves the right to modify, suspend, or terminate any part of the Website’s services at any time.
Unless otherwise explicitly stated, AdriaMart functions only as an online marketplace and is not the direct owner or seller of the listed goods.
10. Intellectual Property
The Website’s logo, trademarks, product images, text descriptions, and page layouts are protected by intellectual property laws.
No individual or organization may copy, distribute, or use any such materials for commercial purposes without prior written authorization.
11. Privacy and Data Protection
The Company complies with the General Data Protection Regulation (GDPR) and applicable Serbian data protection laws.
Only the information necessary for order processing is collected (e.g., name, address, contact details, payment information).
User data is kept strictly confidential and used solely for order fulfillment, customer service, and lawful marketing activities.
Data will not be shared with third parties unless required by law or with the User’s explicit consent.
Users have the right to request access to, correction of, or deletion of their personal data by contacting privacy@adriamart.com.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Serbia.
Any disputes should first be resolved amicably.
If no resolution is reached, disputes shall be submitted to the competent courts of Belgrade, Serbia.
Users may also file complaints with the Serbian Consumer Protection Organization.
In the event of any discrepancy between the Chinese, English, and Serbian versions of these Terms, the English version shall prevail.
